Donations disclosed by TDs, Senators and MEPs for 2002
Part 6. Donations received over the statutory limit
As previously stated, the maximum value of a donation, or donations, which a TD, Senator or MEP can accept from the same person in the same year is €2,539.48. A person includes a political party and any of its branches. Donations from the same person are required to be aggregated and treated as a single donation. Accordingly, donations received by a TD, Senator or MEP from a number of different organs of a political party are required to be aggregated.
It should also be noted that, under the legislation, expenses incurred by a political party (headquarters or branch) on behalf of either a candidate at a Dáil or European election or a TD, Senator or MEP, are not regarded as a donation. Neither are election expenses incurred by a political party on behalf of a candidate at a Seanad election. However, money given to any of the aforementioned by a political party is regarded as a donation and is covered by the provision which prohibits acceptance of a donation exceeding in value €2,539.48.
The €2,539.48 limit does not apply to a donation which is in the nature of a person providing a constituency office to an individual or, if more than one office is provided to the individual, whichever one of those offices is nominated in writing by the individual.
The following individuals disclosed in their Donation Statements that they had received monetary donations in excess of the prescribed limit :

The Standards Commission contacted each of the above drawing their attention to the fact that they had received donations in excess of the prescribed limit. They were advised of the requirements of the legislation and were requested to:
a) confirm in writing to the Standards Commission that the excess amount was returned to the donor, or
b) remit the amount of the excess to the Standards Commission.
In each case it was confirmed to the Standards Commission that the amount of the excess, or a greater amount, was returned to the donor.
