Guidelines for Public Servants (9th edition)

Introduction

This ninth edition of the guidelines for public servants on compliance with the provisions of the Ethics Acts has been drawn up to take account of amendments to the Ethics Acts made by the Civil Partnership and Certain Rights and Obligations of Cohabitants Act 2010. The guidelines also take account of Statutory Instruments enacted in 2011 which prescribe certain organisations as public bodies for the purposes of the Ethics Acts and revise the designated directorships and designated positions in public bodies. S.I. 596 of 2010 and S.I. 645 of 2010 came into effect on 01 January 2011 and this ninth edition of the guidelines applies from that date. Where further regulations prescribing designated directorships and designated positions of employment have been made after 1 January, these guidelines will apply to such directorships and positions from the date indicated in either Appendix 2 or Appendix 3 as approppriate.

Where further regulations are made by the Minister for Public Expenditure and Reform after publication of these guidelines which prescribe public bodies, designated directorshiips and/or designated positions of employment in public bodies, but do not make any substantive changes to the legislative requirements as set out below, the guidelines will not be revised. Any changes to the list of public bodies, designated directorships and/or designated positions of employment will be reflected in the relevant appendix.

These guidelines deal with:

• annual statements of interests;
• statements of a material interest, and
• requirements regarding tax clearance

Appendix 1 contains the formats for statements of interests for use by various categories of public servants.

Appendix 2 sets out the current list of designated positions in civil service Departments/Offices.

Appendix 3 sets out the current lists of designated directorships and designated positions in the wider public service. Appendix 3 also sets out the officer of the body to who designated directors and the relevant authority to whom occupiers of designated positions furnish statements.
